Terms of Service

1. Acceptance of Terms

By accessing or using the website and services provided by Automation For Sellers – Your Brand Assistant LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Products and Services

Digital Products

Our digital products include automation blueprints, Make.com workflow templates, configuration guides, and related digital assets. All digital products are delivered electronically upon purchase. Each product is a one-time purchase granting you a perpetual, non-transferable license to use the materials for your own business operations.

Done-For-You (DFY) Services

DFY services include expert installation, shop launch packages, and listing bundle creation. Service timelines are estimates and may vary based on complexity and client responsiveness. We require access to your accounts (Make.com, Google Workspace, Etsy) to perform installation services.

Community Membership

Community membership provides access to support channels, office hours, resource libraries, and peer networking. Membership is billed through Skool and governed by their terms in addition to ours. Cancellation of membership does not affect previously purchased digital products or installed automation systems.

3. Payment and Billing

All payments for digital products and DFY services are processed by Fungies, our Merchant of Record (MOR). By making a purchase, you also agree to Fungies' terms of service and privacy policy. Fungies handles payment processing, tax collection, and billing inquiries. Prices are listed in USD and include applicable taxes as determined by Fungies.

4. Intellectual Property

Upon purchase, you receive a license to use the digital product for your own business operations. You may not resell, redistribute, share, or sublicense the automation blueprints, templates, or workflows. The underlying intellectual property, including workflow architecture, prompt engineering, and system design, remains the property of Automation For Sellers – Your Brand Assistant LLC.

Content you create using our systems (listings, product images, SEO text) is your own property.

5. Account Requirements

Our automation systems require third-party accounts including but not limited to Make.com, Google Workspace, Etsy, and OpenAI. You are responsible for maintaining these accounts and any associated costs. We are not responsible for changes to third-party services, pricing, or API availability.

6. Limitation of Liability

Our products are automation tools that create draft listings for human review. We do not guarantee sales results, Etsy search rankings, or business outcomes. You are responsible for reviewing all generated content before publishing. We are not liable for any damages arising from the use of our products, including but not limited to lost profits, data loss, or Etsy account actions.

Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid for the specific product or service giving rise to the claim.

7. Etsy Compliance

Our systems generate draft listings that require human review before publishing. You are responsible for ensuring all published listings comply with Etsy's Terms of Service, Seller Policy, and any applicable laws. We do not auto-publish listings and are not responsible for content you choose to publish.

8. Modifications

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the modified terms.

9. Governing Law

These terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.
